The Allahabad High Court has granted the time period of three weeks to Excise Commissioner Prayagraj to submit their reply before the Court regarding the policy of the state government for liquor shops around educational institutions
The Division bench comprising of Justice Manoj Mishra and Justice SK Yadav while dealing with the petition filed by Mahesh Chandra, a licensed shopkeeper of foreign liquor has passed the order to sought information from the Excise Commissioner that there is a policy of the government not to open liquor shops around educational institutions.
“We deem it appropriate to direct that in the Counter Affidavit, the Excise Commissioner, Prayagraj shall also disclose whether there is any State policy with regard to restrictions in opening of Model Wine Shops in close proximity of Educational Institutions.” Said by the Court.
The petitioner has submitted before the court that the advertisement for contracting another shop 190 meters away from the Mainpuri-Etawah State Highway has been published, which is a violation of the rules.

The government lawyer has submitted that the shop is 690 meters away from the Mainpuri-Etawah State Highway. Also, being out of the restricted area, the rules have not been violated.
On this, the court has sought a counter affidavit with government policy. The court said that it is often seen that model wine shops are open near schools.
The next hearing on the petition will be held on November 3 by the court.
